PLEASE READ THIS PRIVACY POLICY CAREFULLY AND IN ITS ENTIRETY BEFORE USING EVOCATIVEWELLNESS.COM (HEREINAFTER REFERRED TO AS THE “SITE”).

This Privacy Policy is here to better serve those who are concerned with how their information is used online. The following outlines what information we collect, how it is used, and the measures we take to protect it.

IMPORTANT NOTE: By using the Site and/or purchasing, viewing, downloading, or otherwise signing up to receive any of Evocative Wellness LLC’s content or services - including but not limited to our email list newsletter, social media content, blog posts, courses, digital downloads, hypnosis audios, AI-based tools, consultations, coaching services, or other offerings (hereinafter collectively referred to as the “Site, Courses, Services, and/or Products”), you voluntarily agree to be bound by this Privacy Policy.

1.Definitions

“Company”, “We”, “I”, “Our”, or “Us” means Evocative Wellness LLC and www.evocativewellness.com.

“Site” means evocativewellness.com and any and all of the Company’s associated pages, tabs, landing pages, forms, or sub-pages.

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Evocative Wellness LLC or evocativewellness.com, and any and all written or downloadable material purchased, viewed, or otherwise offered on evocativewellness.com, such as blog posts, graphics, documents, videos, PDFs, hypnosis recordings, audio programs, AI-based tools (e.g. chatbots or virtual advisiors/agents), and downloadable resources.

“Personal Information” means information that can be used on its own or in combination with other data to identify, contact, or locate an individual. This includes, but is not limited to, your name, email address, mailing address, phone number, payment details, IP address, browser behavior, and any other information voluntarily submitted or collected automatically.

“Site, Courses, Services, and/or Products” refers to all materials and offerings available through evocativewellness.com, including blog content, newsletter sign-ups, courses, digital downloads, hypnosis and mindset audios, AI chatbot tools, quizzes, consults, guides, forms, webinars, guides, and any future offerings —paid or free— provided by the Company.

“You” or “Your” means the user, customer, or viewer of the Site.

The Site and its Content are owned by Evocative Wellness LLC.

Evocative Wellness LLC is committed to protecting your Personal Information. We only collect and use your information as described in this Privacy Policy, and in accordance with applicable data protection laws.

3. What kind of Personal Information do we collect?

Personal Information You Provide:

When using the Site - such as filling out a form, leaving a comment, contacting us, or signing up for a newsletter - you may voluntarily provide personal information such as your name, email address, mailing address, phone number, website, or payment details. We use this information to fulfill your requests (e.g., deliver digital products or respond to inquiries), to improve the Site’s content and user experience, and to send you educational materials, newsletters, promotions, or special offers (if you opt in).

  • Substack Analytics:  If you subscribe to our Substack publication, Substack may collect data about your reading behavior and engagement in accordance with their own Privacy Policy.

    Participate in a quiz, waitlist, survey, AI-based chatbot, or similar interactive tool

If you're just browsing the Site, you are not required to submit any personal information.

For Visitors Outside of the EU: if you sign-up to receive any freebies, downloads, webinars, recordings, courses, or services from the Company, or purchase any products or services from us, you may automatically be added to our email list to receive educational content, updates, and promotional messages. For Visitors in the EU: if you sign-up to receive any freebies, downloads, webinars, recordings, courses, or services from the Company, or purchase any products or services from us, you will only be added to our email list to receive free email messages from us if you affirmatively consent to receiving such messages. 6. How do we use your Personal Information?

When using the Site, Courses, Services, and/or Products, we may use the Personal Information we collect from you when you register, make a purchase, subscribe to our newsletter, respond to a survey or marketing communication (typically by email), interact with our Content or tools, browse the Site, or use certain other Site features in the following ways:

•   To personalize your experience and to allow us to deliver the type of content and product offerings that best match your interests

In general, we do not sell, trade, or otherwise transfer your Personal Information to outside (third) parties for general marketing or advertising purposes. However, we may share or disclose your Personal Information in the following limited circumstances:

  • Legal Requirements: To comply with legal obligations, investigations, law enforcement requests, or as otherwise required by law.

  • Third-Party Service Providers: We may share information with trusted service providers who help us operate the Site and our business. These may include, but are not limited to, email marketing platforms (e.g., Substack), website hosting services, payment processors (e.g. Stripe), learning platforms, or customer service tools. These providers are only given access to your information as needed to perform their functions and are required to keep it confidential.

  • Social Media Platforms: If you use any sharing features (e.g., pinning, reposting, or commenting via social platforms), your information may be shared with those platforms to complete the action you requested.

  • Advertising & Retargeting (Future Use): We may, in the future, use social media advertising (e.g., Facebook or Instagram ads) or remarketing tools that track your behavior on our Site using cookies or pixels. These platforms may collect or receive information from this Site and other online sources to provide ads that are more relevant to you. You can control how these platforms track and use your information through your own account settings.

  • Personalization Tools: If you interact with AI-based tools, quizzes, or chat features on the Site, those tools may collect and remember your responses in order to offer a more personalized experience. This data is used internally to improve your user experience and support relevant content delivery.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. If you make your personal information available to third parties through our Site, Courses, Services, and/or Products, Evocative Wellness LLC is not responsible for any unauthorized use by that third party.

It's also important to note that we do allow third-party behavioral tracking for analytics and potential advertising purposes.

8. How do we protect your Personal Information?

We aim to make your experience on our Site as safe as possible. The Site uses commercially acceptable methods of security protection to protect your information. Our Site is hosted on a privately managed virtual server through Vultr, a third-party cloud infrastructure provider. We implement commercially reasonable security measures to protect your information, including SSL encryption for all data transmitted between your browser and our Site, AES-256 encryption for our website database, access controls limiting who can access your information, and regular server monitoring. While we take security seriously, please note that no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Your Personal Information is contained behind secured networks and is accessible only to individuals who have special access rights and are required to keep such information confidential. 

By viewing, using, or purchasing on or from the Site, Courses, Services, and/or Products, you acknowledge that Evocative Wellness LLC and its team members (including independent contractors, if applicable) may access your Personal Information as necessary for Business Operations.

If and when we begin accepting payments through the Site, all transactions will be processed securely through a PCI-compliant third-party gateway (such as Stripe). We do not store or process credit card information on our servers.

9. Do we use 'cookies' or social media pixels?

Cookies. Yes. We, and third-parties as described in Section 7 herein, use cookies and collect information from the computer, mobile phone, or other device you use to access the Site, read our emails, or view our advertisements. This information is automatically collected. Cookies are small data files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better site experiences and tools in the future.

We use cookies to:

You can choose to disable cookies through your browser settings. However, doing so may affect your experience and limit certain features or functionality of the Site, Courses, Services, and/or Products.

Pixels. No. We do not currently use social media tracking pixels (such as the Facebook pixel). However, we reserve the right to use such tools in the future in accordance with the terms and conditions of the relevant platforms (e.g., Facebook, Instagram, Pinterest, etc.).

If and when implemented, these pixels would allow us to track visitor behavior and deliver targeted advertisements across those platforms. You can manage your preferences or opt out of interest-based advertising by adjusting your ad settings within each social media platform.

10. Third-Party Links:

Occasionally, at our discretion, we may include or link to third-party products, services, or to external websites, including articles, blogs, or other resources. These third-party sites may or may not have separate privacy policies, which operate independently of our own.

We are not responsible for the content, policies, or practices of these linked sites and disclaim any liability related to their content or activities. However, we are committed to protecting the integrity of our Site, and we welcome feedback about any external links by contacting us at hello@evocativewellness.com.

11. Password Privacy:

If, now or in the future, you are given access to any password-protected areas of the Site, Courses, Services, and/or Products, you are responsible for maintaining the confidentiality of your login information. This includes your username, password, and any credentials tied to your account.

You are solely responsible for all activities that occur under your login, whether authorized by you or not. If you become aware of any unauthorized use of your login credentials or any breach of security, please notify us immediately at hello@evocativewellness.com.

You agree not to share your login credentials with anyone else. We are not liable for any loss or damage resulting from your failure to protect your account or from unauthorized use of your credentials.

12. Google Ads & Analytics:

We do not currently use Google Analytics or Google Ads. However, we reserve the right to implement these tools in the future to better understand how visitors use the Site and to deliver relevant advertising. If implemented, Google and third-party vendors may use cookies to collect data about interactions with our site. If we do, this section will be updated to reflect any changes. 

To Opt-Out of Google Ads: You can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt-out by visiting the Network Advertising Initiative Opt-Out page or by using the Google Analytics Opt-Out Browser add-on. These tools allow you to control what data is collected and how it is used across participating websites.

13. California Online Privacy Protection Act (“CalOPPA”):

CalOPPA extends beyond California to require any person or company that operates websites collecting Personal Information from California viewers/consumers to post a clear and accessible privacy policy on its website, stating exactly the information is collected and how it is used and shared. In accordance with CalOPPA, we affirm the following:

  • Users can visit our site anonymously.

  • There is a link to this Privacy Policy in the footer of each page of the Site.

  • Our Privacy Policy is clearly titled “Privacy Policy” and includes the word "Privacy" for easy identification.

  • Users will be notified of any changes to this policy by viewing the “Last Updated” date at the top of this page. 

14. Children’s Online Privacy Protection Act (“COPPA”):

We do not specifically market to or knowingly collect Personal Information from children under the age of 13. If you are under 13 years old, please do not use, view, purchase, or browse the Site, Courses, Services, or Products. You are not permitted to submit any Personal Information through this Site.

If you are a parent or guardian and believe that your child under the age of 13 has provided us with Personal Information, please contact us immediately at hello@evocativewellness.com so that we may delete it from our records.

15. Fair Information Practices:

In order to comply with Fair Information Practices, we will take the following responsive action, should a data breach occur:

We will notify you via email within 7 business days of becoming aware of any known breach that may have compromised Personal Information.

We also agree to cooperate with regulatory authorities and law enforcement, as required by applicable data protection laws. If we are legally required to notify individuals or government bodies following a breach, we will comply promptly and transparently.

16. CAN-SPAM Act of 2003:

The CAN-SPAM Act is a U.S. law which establishes rules for commercial email communications, establishes requirements for email transparency, and gives recipients the right to stop receiving certain types of email.

 We collect your email address and name in order to:

•   Send information, respond to inquiries, and/or other requests or questions.

•   Process orders and to send information and updates pertaining to orders of a course, product, or service.

•   Send you additional information related to your course, product and/or service.

•   Market to our mailing list or continue to send emails to you after the original transaction has occurred.

•   Email you a newsletter with free information and advertising certain Products, Services, and/or Courses we offer.

• Share updates, promotions, and resources that may interest you

In accordance with the CAN-SPAM Act, we agree to the following:

•   We will not use false or misleading subjects or email addresses.

•   We will identify the email message as an advertisement in some reasonable way.

•   We will include our business mailing address and/or physical address in our emails.

•   We will monitor third-party email marketing services for compliance. We use Substack to send newsletter communications and email sequences. Direct correspondence may also be sent from hello@evocativewellness.com via Gmail, our business email platform.

•   We will honor opt-out/unsubscribe requests promptly.

•   We will allow users to unsubscribe by using the appropriate link at the bottom of each email.

How to Unsubscribe

You can unsubscribe from our emails at any time by clicking the “unsubscribe” link at the bottom of any email you receive from us. If you experience issues with unsubscribing or wish to be removed manually, please contact us at hello@evocativewellness.com, and we’ll promptly remove you from all applicable lists.

Please note: Unsubscribing from one type of email (e.g., a course sequence) may not unsubscribe you from all email communications. You may need to unsubscribe from each category separately.

17. Your General Data Protection Regulation ("GDPR") Rights

If you are located within the European Union ("EU"), you are entitled to certain rights under the GDPR including the right to:

●        Know how long your personal information will be retained. We will keep your information until the earlier of: (1) you request that we delete your data, or (2) we determine that the information is no longer needed and the cost of retaining it outweighs the value.

●        Access, update, or request the deletion of your personal information.

●        Withdraw your consent to the Company's processing of your data, which shall have no effect on the lawfulness of the processing of your personal information prior to your withdrawal.

●        Lodge a complaint with a supervisory authority that has jurisdiction over GDPR issues.

●        Provide only the personal information that is reasonably necessary to engage in a transaction or contract with us. The Company will not ask for your consent to provide unnecessary personal information on the condition of entering into a contractual relationship with the Company.
